The National Human Rights Commission (NHRC), India has taken suo motu cognizance of the alleged misuse of its name and logo by certain Non-Governmental Organisations (NGOs) operating under deceptively similar titles. The move follows the Commission’s observation, while reviewing complaints, that multiple organisations have registered names closely resembling that of the statutory body, potentially misleading the public.

According to the Commission, such practices create the false impression that these entities are affiliated with or authorised by the NHRC. It cautioned that the continued use of illusory names could undermine public trust, lead to misrepresentation of mandate, enable possible misappropriation of funds, and cause difficulties for authorities in distinguishing between legitimate institutions and private organisations.

A recent instance cited by the Commission involves an NGO registered as “National Human Rights Council (NHRC),” reportedly registered in Delhi in 2022. The organisation’s promotional materials allegedly claimed associations with various government bodies and institutions. The Commission noted that the adoption of the acronym “NHRC” and the use of designations such as “Chairman” were misleading and capable of creating public confusion.

Despite earlier advisories and communications to concerned authorities about preventing misuse of its identity, the Commission stated that violations have persisted. In response, the NHRC has issued notices to the Chief Secretaries and Director Generals of Police (DGPs) of all States and Union Territories, directing them to identify individuals or organisations misusing the Commission’s name or operating under similar nomenclature. Authorities have been asked to initiate appropriate legal action within two weeks, including cancellation of registrations obtained in violation of norms.

Additionally, specific reports have been sought from the Chief Secretary and DGP of Karnataka, as well as the Chief Secretary and Commissioner of Police of Delhi, regarding action taken against the NGO in question. The Commission also urged registering authorities to remain vigilant to prevent further instances of misrepresentation.
