Bombay High Court Questions Vijay Mallya’s Intent in Fugitive Status Challenge

A hearing was held today in the Bombay High Court in matters concerning Vijay Mallya, who informed the court that he is unable to specify when he would return to India. Mallya cited orders passed by courts in England that allegedly prevent him from leaving the country.

The Bench, comprising Chief Justice Alok Aradhe Chandrashekhar and Justice Gautam Ankhad, heard two petitions filed by Mallya — one challenging his designation under the Fugitive Economic Offenders (FEO) framework and another contesting a court order declaring him a fugitive.

Senior Advocate Amit Desai, appearing for Mallya, argued that several Supreme Court judgments have permitted writ petitions to be heard even in the absence of petitioners. The Bench, however, raised concerns regarding Mallya’s intent to appear before the court, observing that while he relied on English court orders, it remained unclear whether those orders had been legally challenged. The court described the explanation as insufficient.

Desai submitted that extradition proceedings involving his client are ongoing, but maintained that Mallya is bound by restrictions under the English legal system.

The court directed Solicitor General Tushar Mehta to file a reply to Mallya’s affidavit. It also instructed Desai to submit a detailed affidavit placing on record all statements made during the hearing.

Noting that the petitions have been pending since 2019, the Bench remarked that no sincere efforts had been made for early disposal. The matter is scheduled for further hearing on March 11.
