Uttarakhand High Court Slams Police for Detaining Leader En Route to Parliament March

Dehradun: The Uttarakhand High Court has strongly reprimanded the state police for detaining Uttarakhand Parivartan Party leader Prabhat Dhyani while he was travelling to Delhi to participate in the CJP-led Parliament March. The court declared the police action illegal and questioned the authority under which Dhyani was prevented from continuing his journey.

Dhyani was stopped and taken into custody at Rishikesh Railway Station on July 20 while on his way to the national capital. A habeas corpus petition challenging his detention was subsequently filed before the High Court.

During the hearing, the bench criticised the police's actions, observing that the prohibitory orders under Section 144 were in force in Delhi, not in Uttarakhand. The court questioned how the Uttarakhand Police could prevent a citizen from travelling to another state, describing the action as "goondagardi" (hooliganism).

The court further emphasised that every citizen has a constitutional right to move freely across India. It asked the police what legal authority they had to stop Dhyani from travelling, noting that if any law-and-order issue arose in Delhi, it would be the responsibility of the Delhi Police to handle it.

Expressing concern over the conduct of the authorities, the bench remarked that the role of the police is to protect citizens' constitutional rights, not to safeguard the government's image. The court described the police's approach in the matter as "completely absurd."
