Plea Filed in Supreme Court Against Sonam Wangchuk's Removal From Hunger Strike at Jantar Mantar
Petition seeks permission for Wangchuk to resume his fast, questions Delhi Police action, and calls for protection of peaceful protesters' rights.
The removal of environmentalist and education reform advocate Sonam Wangchuk from his hunger strike at Jantar Mantar has reached the Supreme Court of India. Advocate Narendra Mishra has written to the Chief Justice of India, requesting that the matter be treated as a Public Interest Litigation (PIL).
The petition challenges the Delhi Police's decision to remove Wangchuk from the protest site after nearly three weeks of fasting. It argues that the action violated the fundamental rights of Wangchuk and other peaceful protesters.
According to the plea, the protest was focused on key issues affecting students across the country, including alleged irregularities in the NEET examination, repeated paper leaks, lack of transparency in recruitment and entrance exams, and concerns over the authenticity of mark sheets and academic records. The petition states that these issues impact the future of millions of students and require urgent attention.
Wangchuk, who had been leading the movement, was shifted from Jantar Mantar for medical care after his health deteriorated, leaving the protest without its central figure. The petition also notes that Leader of the Opposition Rahul Gandhi had previously raised concerns over examination irregularities.
Citing Article 19 of the Constitution, the plea emphasizes the right to peaceful protest and urges authorities to act in a fair and balanced manner. It also refers to Article 21, highlighting the need to safeguard the life and health of protesters, particularly those on an indefinite hunger strike.
The petition requests the Supreme Court to direct the Delhi Police to allow the peaceful protest and hunger strike to continue at Jantar Mantar. It also seeks adequate medical facilities at the protest site and asks the court to ensure that Wangchuk is allowed to return to the venue if he is not found to have engaged in any unlawful activity.
